Det inneb\u00e4r ocks\u00e5 att f\u00f6lja de lagar som finns f\u00f6r att skydda b\u00e5de s\u00f6kande och arbetsgivare. Tv\u00e5 regelverk som \u00e4r s\u00e4rskilt viktiga i samband med rekrytering \u00e4r <strong>GDPR<\/strong> och <strong>Diskrimineringslagen<\/strong>. Vi ser ofta att organisationer saknar full kunskap inom dessa omr\u00e5den, n\u00e5got som kan medf\u00f6ra kostsamma och tidskr\u00e4vande konsekvenser.<\/p>\n\n\n\n<h2 class=\"wp-block-heading h4\"><strong>Diskrimineringslagen \u2013 Vad <\/strong>inneb\u00e4r den?<\/h2>\n\n\n\n<p><strong>Diskrimineringslagen (2008:567)<\/strong> f\u00f6rbjuder b\u00e5de direkt och indirekt diskriminering p\u00e5 grund av:<br>k\u00f6n, k\u00f6nsidentitet, etnisk tillh\u00f6righet, religion, funktionsneds\u00e4ttning, sexuell l\u00e4ggning och \u00e5lder.<\/p>\n\n\n\n<p><strong>Viktigt att t\u00e4nka p\u00e5 vid en rekrytering<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list mb-0\">\n<li class=\"mb-0\">Kraven i en platsannons m\u00e5ste vara objektiva och relevanta.<\/li>\n\n\n\n<li class=\"mb-0\">Undvik intervjufr\u00e5gor som kan kopplas till n\u00e5gon av diskrimineringsgrunderna.<\/li>\n\n\n\n<li class=\"mb-0\">Kandidater har r\u00e4tt att \u00f6verklaga ett beslut i upp till <strong>tv\u00e5 \u00e5r<\/strong>, vilket g\u00f6r att hela rekryteringsprocessen beh\u00f6ver dokumenteras och ans\u00f6kningarna sparas minst lika l\u00e4nge.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading h4\"><strong>GDPR \u2013 <\/strong>Hur personuppgifter ska hanteras i rekrytering<\/h2>\n\n\n\n<p>GDPR reglerar hur personuppgifter f\u00e5r behandlas under en rekryteringsprocess och st\u00e4ller krav p\u00e5 tydlighet, s\u00e4kerhet och ansvar.<\/p>\n\n\n\n<p><strong><strong>Viktigt att t\u00e4nka p\u00e5<\/strong><\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list mb-0\">\n<li class=\"mb-0\">Integritetspolicy &#8211; S\u00f6kande ska redan vid ans\u00f6kan f\u00e5 information om hur l\u00e4nge uppgifterna lagras och vilka r\u00e4ttigheter de har.<\/li>\n\n\n\n<li class=\"mb-0\">Beh\u00f6righetsstyrning &#8211; Endast personer som beh\u00f6ver \u00e5tkomst till ans\u00f6kningarna ska ha det.<\/li>\n\n\n\n<li class=\"mb-0\">Ans\u00f6kningar i mejlkorgen &#8211; Kontrollera \u00e5tkomst, vem som hanterar inkorgen vid personalf\u00f6r\u00e4ndringar och att uppgifter raderas inom r\u00e4tt tid.<\/li>\n\n\n\n<li class=\"mb-0\">Ans\u00f6kningar p\u00e5 dator eller molntj\u00e4nster &#8211; S\u00e4kerst\u00e4ll \u00e5tkomstkontroll och ansvar f\u00f6r att radera data efter tv\u00e5 \u00e5r.<\/li>\n\n\n\n<li class=\"mb-0\">Utskrivna ans\u00f6kningar &#8211; Begr\u00e4nsa insyn och se till att dokument f\u00f6rst\u00f6rs enligt g\u00e4llande tidsramar.<\/li>\n\n\n\n<li class=\"mb-0\">Kontinuerlig gallring &#8211; Personuppgifter ska tas bort n\u00e4r rekryteringen avslutas, om det inte finns ett tydligt annat \u00e4ndam\u00e5l. Samtidigt m\u00e5ste ans\u00f6kningar sparas <strong>minst tv\u00e5 \u00e5r<\/strong> f\u00f6r att f\u00f6lja diskrimineringslagstiftningen. Vissa kan sparas l\u00e4ngre n\u00e4r b\u00e5da parter har ett dokumenterat och ber\u00e4ttigat intresse.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Vid brott mot GDPR kan sanktionsavgifter n\u00e5 upp till <strong>20 miljoner euro<\/strong> eller <strong>4 % av koncernens globala \u00e5rsoms\u00e4ttning<\/strong>, d\u00e4r det h\u00f6gsta beloppet g\u00e4ller.
